Experiences from the U.S. with Class Action and Product Liability
Product liability has become a major factor in manufacturers’ decisions whether to export to another country, as well as for insurers deciding whether to provide cover for the corresponding risks.
This booklet, written in cooperation with Nixon Peabody, reviews Class Action laws in the United States and compares the legislation with the new Swedish Group Proceedings Act. A class action is a form of civil lawsuit where normally a large group of individuals, that would contain too many to name independently, have similar claims against a defendant or defendants. The emphasis is put on how to defeat Class Actions and how a company can avoid making mistakes in the defense of Class Actions.
